配送業者は注文者と直接の契約してないのに、注文者はどうやって配送業者に責任問うの？
配送業者が責任負うのは彼らの直接の依頼主(今回でいうショップ)に対してであって、
配送中のトラブルが起こったときに注文者に対して責任を負うのは、直接の契約を交わしているショップでしょうに。
当然ショップは配送業者に対して責任を問えるような契約を交わしているはず。ていうかだいたいの配送業者の約款はそうなってる。

「輸送トラブルが起こったときは配送業者と直でやりとりしてね」みたいな糞ショップは使わないほうが賢明。
